Terms of Service

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("you" or "User") and MB Djump, a private limited liability company registered in the Republic of Lithuania, operating under the trade name Jumzy Kids ("we", "us", or "Jumzy Kids"), regarding your access to and use of the Jumzy Kids mobile application (the "App"), website, and related services (collectively, the "Service").

If you do not agree to these Terms, do not install, access, or use the Service. By installing or using the App, you indicate your acceptance of these Terms.

2. Age Requirements & Parental Consent

By creating an account, you represent and warrant that:

• You are at least 18 years old
• You are the parent or legal guardian of each child who will use the App on your account
• You consent to the processing of your child's data as described in our Privacy Policy
• You will supervise your child's use of the App, especially for children under 7
• The information you provide is accurate and truthful

3. Service Description

Jumzy Kids is a parental control and physical activity app featuring:

• On-device AI movement detection using Google ML Kit Pose Detection (Android) and Apple Vision framework (iOS)
• 12+ exercises designed for children ages 4-14 with age-appropriate difficulty
• Parental app blocking that requires children to complete exercises before accessing selected apps
• Screen time window scheduling (weekdays / weekends)
• Family system with multiple child profiles and a parent dashboard
• Gamification system with achievements, streaks, points, and a virtual shop
• Optional premium subscription unlocking additional exercises

4. Account Creation and Security

• You must provide a valid email address and create a password
• You must set a 4-digit parental PIN to protect parent-only settings
• You are responsible for maintaining the confidentiality of your account credentials
• You are responsible for all activities that occur under your account
• Notify us immediately at start@djump.io of any unauthorized access
• You may not share your account credentials outside your immediate family
• You may create one account per household

5. Acceptable Use Policy

You agree NOT to:

• Use the Service for any unlawful purpose or in violation of any local, state, national, or international law
• Reverse engineer, decompile, disassemble, or attempt to extract the source code of the App
• Modify, adapt, translate, or create derivative works of the App
• Remove any copyright, trademark, or proprietary notices
• Use automated systems (bots, scrapers) to access the Service
• Attempt to gain unauthorized access to our servers or another user's account
• Interfere with or disrupt the Service or servers
• Upload or transmit malicious code, viruses, or harmful content
• Use the Service to harass, abuse, or harm another person
• Circumvent the parental controls for malicious purposes
• Resell, sublicense, or redistribute the Service

8. Safety Guidelines

You agree to ensure the following when your child uses Jumzy Kids:

• Clear, safe exercise space of at least 2m × 2m, free of obstacles and sharp objects
• Children ages 4-7 require direct adult supervision at all times
• Non-slip flooring and appropriate athletic footwear
• Comfortable, loose clothing that allows free movement
• Adequate hydration before and after sessions
• Rest between exercise sessions, especially for younger children
• No exercising near stairs, windows, or water
• Device stability (phone/tablet placed securely)

9. Subscriptions, Pricing, and Billing

Free and Premium Tiers

Jumzy Kids offers a free tier with a limited set of exercises and a premium subscription unlocking all exercises and features. Current pricing is displayed in the App before purchase.

Payment Processing

All payments are processed through Apple App Store (iOS) or Google Play Store (Android). Subscription activation is managed by RevenueCat on our behalf. We never receive or store your payment card details.

Auto-Renewal

Subscriptions automatically renew at the end of each billing period unless cancelled at least 24 hours before the end of the current period. Your account will be charged for renewal within 24 hours of the end of the current period. You can manage and cancel your subscription at any time through your device's account settings:

• iOS: Settings → [Your Name] → Subscriptions → Jumzy Kids
• Android: Google Play Store → Profile → Payments & subscriptions → Subscriptions → Jumzy Kids

Free Trial

If a free trial is offered, you will be informed of its duration before starting. Cancel at least 24 hours before the trial ends to avoid being charged for the first subscription period.

Family Sharing

Jumzy Kids subscriptions support Apple's Family Sharing (iOS) and Google Play Family Library (Android), allowing one subscription to be shared with up to 5 additional family members in your organizer group, subject to Apple's and Google's Family Sharing rules.

Refunds

Refund requests are handled by Apple and Google according to their respective policies. Request refunds directly through:

• Apple: reportaproblem.apple.com
• Google Play: play.google.com/store/account/orderhistory

Under EU law, if you purchased the subscription directly from us as a digital service, you have the right to withdraw within 14 days, unless you explicitly waived this right and the service has begun.

Price Changes

We may change subscription prices from time to time. Price changes will be communicated at least 30 days in advance via email and in-app notice, and will only take effect at the start of your next billing period. You may cancel before the change takes effect.

10. Intellectual Property

All content, features, and functionality of the Service — including but not limited to the Jumzy Kids name and logo, trademarks, graphics, icons, animations, audio, video, user interface design, code, exercise instructions, and all other elements — are owned by MB Djump or its licensors and are protected by copyright, trademark, and other intellectual property laws of Lithuania, the European Union, and international treaties.

We grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on your personal devices for personal, non-commercial purposes only, subject to these Terms. No other rights are granted.

11. User Content

Jumzy Kids does not include features for users to post, upload, or share content publicly. The only data you provide is your email, password, parental PIN, and child profile settings, all of which are used solely to provide the Service as described in our Privacy Policy.

12. Disclaimer of Warranties

13. Limitation of Liability

To the maximum extent permitted by law, MB Djump, its directors, employees, partners, and suppliers shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of, or inability to access or use, the Service
• Any conduct or content of any third party
• Unauthorized access to or alteration of your data
• Injuries sustained during physical exercise
• Any other matter relating to the Service

In any event, our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or EUR 50, whichever is greater. This limitation does not apply to liability that cannot be excluded under applicable law (e.g., for gross negligence or willful misconduct).

14. Indemnification

You agree to indemnify, defend, and hold harmless MB Djump and its affiliates from any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your breach of these Terms; (b) your violation of any law or the rights of a third party; or (c) your misuse of the Service.

15. Termination

You may terminate your account at any time by deleting your account in the App or contacting us at start@djump.io. We may suspend or terminate your access to the Service at any time, with or without notice, if you breach these Terms, engage in fraud, or violate any applicable law. Upon termination, your right to use the Service will immediately cease, and we will delete your personal data as described in our Privacy Policy.

16. Changes to These Terms

We may revise these Terms from time to time. For material changes, we will notify you at least 30 days in advance via email and in-app notice. Your continued use of the Service after the effective date of the revised Terms constitutes your acceptance. If you do not agree to the revised Terms, you must stop using the Service.

17. Third-Party App Stores

You acknowledge that your use of the App through Apple App Store or Google Play Store is also subject to those stores' respective terms and policies. Apple and Google are not responsible for the App or its support. In case of any conflict between these Terms and the app store terms, these Terms prevail for matters between you and MB Djump.

18. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Lithuania, without regard to its conflict of laws principles. Any dispute arising out of or relating to these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Klaipėda, Lithuania, subject to any mandatory consumer protection laws of your country of residence that cannot be waived.

EU consumers may also use the European Commission Online Dispute Resolution platform.

19. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary so that the remaining provisions of these Terms continue in full force and effect.

20. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and MB Djump regarding the Service and supersede all prior agreements and understandings, whether written or oral.
